Christian Flag Case Against City Of Boston Settles: City Pays Out $2,125,000.00

BOSTON, MA – After five years of litigation and a unanimous 9-0 U.S. Supreme Court ruling, the City of Boston has agreed to pay Liberty Counsel $2,125,000.00 for attorney’s fees and costs for the unconstitutional religious viewpoint discrimination of the Christian flag.
In Shurtleff v. City of Boston, Liberty Counsel represents Boston resident Hal Shurtleff and his Christian civic organization, Camp Constitution. Shurtleff and Camp Constitution first asked the city in 2017 for a permit to raise the Christian flag on the “public forum” Boston City Hall flagpole to commemorate Constitution Day and Citizenship Day (September 17) and the civic and cultural contributions of the Christian community to the city of Boston, the Commonwealth of Massachusetts, religious tolerance, the Rule of Law and the U.S. Constitution. For 12 years, from 2005 to 2017, Boston approved 284 flag raisings by private organizations with no denials on the flagpoles that it designated a “public forum.” However, the city official denied Camp Constitution’s application in 2017 to fly the Christian flag on Constitution Day.

The policy stated that the flagpole was open to all applicants, but the City of Boston denied Hal Shurtleff’s application for the sole reason that the application form referred to the flag as a “Christian” flag. Had the application used any other non-religious word, Boston would have granted the request.
After four lower court losses, the U.S. Supreme Court ruled 9-0 on May 2, 2022, that Boston’s denial of the flag was unconstitutional viewpoint discrimination under the First Amendment Free Speech Clause.

The Justices in Shurtleff unanimously rejected Boston’s argument that religious viewpoints must be censored under the 1971 Supreme Court case, Lemon v. Kurtzman. On June 27, in the Coach Kennedy case, Justice Gorsuch pointed to Shurtleff as the basis for overturning Lemon. The so-called “Lemon Test” did considerable damage to the First Amendment Free Speech, Free Exercise, and Establishment Clauses.

The Christian flag finally flew on the Boston City Hall Plaza public forum flagpole on August 3 as an enthusiastic crowd cheered to celebrate the first day free of unconstitutional viewpoint discrimination.

Liberty Counsel Founder and Chairman Mat Staver said, “We are pleased that after five years of litigation and a unanimous victory at the U.S. Supreme Court, we joined with Hal Shurtleff to finally let freedom fly in Boston, the Cradle of Liberty. The Christian flag case has established significant precedent, including the overturning of the 1971 ‘Lemon Test,’ which Justice Scalia once described as a ‘ghoul in a late night horror movie.’ The case of Shurtleff v. City of Boston finally buried this ghoul that haunted the First Amendment for 51 years.”

Mental Health Investigation Ended Up With Officer Being Stabbed

A Los Angeles Police Department Mission Division Patrol Officer sustained nonlife-threatening injuries while responding to a Mental Health Investigation call. On Sunday, November 6, 2022, around 7:22 p.m., officers responded to the area of the 7200 block of South Hobart Blvd. for a radio call of a family dispute involving a mentally ill male.

When officers arrived, they met with the suspect’s mother, who explained that her son was experiencing a mental health crisis and he was in the nearby area. Officers’ saw the suspect and attempted to make contact with him.

The suspect was non-compliant, and attempted to conceal himself behind a food truck. As the officers tried to locate the suspect behind the truck, he rushed toward the female officer with a knife in his right hand. He attempted to stab the officer in the neck and face area. The officer raised her hand to block the knife, which resulted in a stab wound to her left hand. The force of the suspect’s actions caused the officer to fall to the ground, with the suspect on top of her.

The partner officer then became engaged in a Use of Force (UOF) incident with the suspect. The suspect fled from officers, which resulted in a foot pursuit. An “Officer Needs Help,” request was broadcast by the involved officers. Responding officers arrived in the area and a second UOF occurred.

The suspect then was taken into custody without injury or complaint of pain. A crime scene was established and evidence was documented and collected. The female officer was transported to a local hospital in stable condition. She was admitted and will undergo surgery for her injuries. The suspect was identified as 22-year-old Arlandus Triplett. He was arrested for Attempt 187 (A) PC- Attempt Murder on a Police Officer. The criminal case against Triplett is being reviewed by the Los Angeles County District Attorney’s Office for felony filing consideration.

Wind, Wind, Go Away, Come Again Some Other Day: Wyoming Gets Hit With 80-90 MPH Wind Gusts

According to the National Weather Service, wind gusts hit 90 miles per hour southeast of Horse Creek. Other wind gusts were recorded and reported at over 80 miles per hour, and others were over 74 miles per hour which, according to the weather experts, is a hurricane-force wind or category one hurricane.
Is this a precursor to what Wyoming winter storms will be like this year? Time will tell.

Park County District Court Judge Jason Conder Dismisses Class Action Suit

Judge Jason Conder dismissed a Class Action Lawsuit filed in Park County District Court. The Class Action suit filed by Tri-County Telephone Association alleges in the complaint that TCT, which Big Horn Telecommunications acquired, was a grand scheme of fraud, deceit, and collusion.

TCT released a press release that stated the following: “The court’s recent order is a full vindication of the honest and diligent efforts of the former officers and directors to negotiate and present to the cooperative members, for their approval, a transaction in the interests of those members, the company and our community.”

According to court records, the suit had been initiated by Bill and Barbara Campbell, and William Loveland as plaintiffs.

The Defendants were TCT, all affiliated companies, and multiple individuals involved either in the purchase of the TCT or the Sale of the TCT company.

According to the Court document, “Defendants breached their duty of loyalty, fidelity and good faith,” the plaintiffs alleged. In addition, the allegations revealed that the buy/sale was a scam and that millions of dollars cheated the then-owners of TCT out of the money they could have had.

To make a long, convoluted trail of facts and non-facts alleged in the complaint, Park County Judge Jason Conder stated that the Plaintiffs did not provide enough evidence or sufficient evidence to support their claim against the Defendant(s).

“Plaintiffs have failed to present specific facts demonstrating that a genuine issue of material fact exists as to intentional torts or illegal acts. Plaintiffs must do more than loudly and repeatedly state their allegations and opinions. They must provide some measure of proof, evidentiary facts to support their position and overcome the business judgment rule, which they have failed to do.” Judge Jason Conder wrote in his ruling.

In TCT’s press release, they comment on the Court ruling.

According to TCT officials, this was a frivolous lawsuit initially, but now that it is over, we can focus on providing excellent exceptional service to our customers.
