File Federal Law Suit Against Multiple School Boards. Part #2

Interesting how the government unlawfully and unconstitutionally seized control of such common law and Constitutional protected rights. As proof of In Exhibits 1 and 2.

The willful, exaggeration of fear of death was fueled by Wyoming politicians and propagandized by irresponsible Wyoming Liberal media; and the shear complexity of science and medicine involved which many citizens, legislative bodies, and judiciary did not take the time necessary to properly understand COVID-19 which is just a simple FLU virus and then the irrational and elusive goal of completely eliminating the virus at any cost, including massive economic devastation physical and psychological scarring to millions of innocent populace, and the loss of the personal freedoms that our forefathers and their successors gave their lives to preserve and protect.

What a SHAM the all the defendants slipped under the eyes of the Wyoming population. Has not history taught Americans that for over 100 years, Americans have survived pathogenic outbreaks of such diseases as smallpox, cholera, typhoid and many others with far higher mortality rates than COVID-19 ever caused, Yet back then Americans were left to educating people with facts but then leaving the people to decide for themselves on what health measures to take, and allowing commerce to continue unfettered.

In this case the Petitioners in this action are asking the Court to set aside all the policies mandates requiring the use of masks, social distancing, testing, Quarantining, and forced vaccination of healthy and asymptomatic individuals for all school children, visitors, teachers and administrators. Some of the reasons for this action include but are not limited to:

There is no medical emergency that justifies the use of the Respondents’ policies requirements/mandates regarding as it applies to Pre-Kindergarten through Twelfth Grade.

The remedy requiring the use of use of face-coverings, social distancing, testing or the quarantining for all students, teachers, staff and visitors does not accomplish the stated goal.

The Respondents/Defendants’ policies requirement/mandates regarding the use of face coverings for all students, teachers, staff and visitors, are, and have been arbitrarily made and enforced without any creditable basis in science.

The remedy requiring the use of face-coverings, social distancing, testing or the quarantining for all students, teacher, staff and violations of constitutionally secured and protected fundamental rights.

Health emergencies do not warrant coercion that is indiscriminate, overbroad, excessive, or without creditable evidentiary support. The Respondents’ policy requirements/mandates regarding the use of face-coverings. social distancing, testing or the quarantining of healthy and asymptomatic individuals are not based on the best available credible scientific evidence, instead it is based on falsified evidence.

Wyoming Results of Call To Action “Conflict of Interest”

The SF1003 failed miserably, in the senate. The how and why’s are important, but a battle was won in this matter. That matter is Senator R.J. Kost’s vote on SF1003. As you previously read, the senator representing Park and Big Horn counties also serves, concurrently, on two other entities in addition to the Wyoming legislature: the Powell Hospital District Board of Trustees (an elected position) and President of the Powell Valley Healthcare Board.

His involvement in those entities was pointed out as a possible conflict of interest and the good senator confirmed it is. Prior to a vote amending SF1003 Senator Kost announced he would not be voting due to a “CONFLICT”! You can see and hear his brief comment at https://www.youtube.com/watch?v=jSqvoM64wnk between the 2:26 – 2:35 minute mark. Again, he declared “conflict” for the vote on the bill at 9:28 – 9:40 minute mark.

The senator declared conflict because people became aware of his ties to the healthcare industry, and voiced their concerns to him (thank you for taking an active part in the matter). Moreover, the senator may have realized his positions put him direct conflict with his ability to vote and serve the people of the State of Wyoming. That would be mind reading, but in the absence of hearing anything from the senator what can one assume? The obvious!

Senator Kost announced, not once, but twice that he is in conflict with the bill, a bill relating to healthcare matters. Therefore, he should absent himself from the remaining special session since everything pertaining to the special session is healthcare related.

Throughout his term in office it would appear the senator representing senate district 19 has voted, either in committee or the senate floor, on matters that are healthcare related, and having benefit or consequence to entities on which boards he serves on, and/or himself. Thus questions come about regarding this senator:

Has his votes been in the best interest of the people he represents or the boards he serves on?

Has he violated Wyoming State Statute 22-2-116? “No person may hold an elective public office in any governmental entity which either provides any funding for or receives any funding from another governmental entity in which that person holds elected public office. If a person also is elected to a public office while holding another public office such that this section is applicable, the person shall resign from the public office first held prior to assuming the new office.”

Is he in direct violation of the Wyoming State Constitution Article 3, Section 46 Interested member shall not vote? “A member who has a personal or private interest in any measure or bill proposed or pending before the legislature shall disclose the fact to the house of which he is a member, and shall not vote thereon.”

Has he violated ethical rules of the Senate by not previously disclosing his conflict of interest?

OPINION from Governor Gordon: “Government should be limited”

From Wyo Governor Mark Gordon:

Wyoming has always been about small government and limited regulations. These are core values to me. I remember well my father working to protect Wyoming’s Right to Work laws. Our family eagerly supported Malcolm Wallop’s successful Senate bid in 1976. He was unshakeable in his conservatism and fought constantly against government overreach. In fact, one of the most memorable political ads of all time was Malcolm taking the Occupational Safety and Health Administration to task for ridiculous regulations. It featured a puzzled cowboy preparing to head out on the range, and having to strap a portable toilet to a pack horse because of OSHA’s over-regulation. It was a great ad that highlighted wrongheaded regulations crafted in DC that lack awareness of what makes sense on the ground.

Big government is a cancer. As a conservative Republican I have, and always will support the rights of private individuals and their rights as business owners to operate their enterprise as they see fit. We need fewer regulations, not more. I oppose growing government interference.

As I write this, OSHA is preparing new rules that purport to shape how businesses must operate across the country. In this instance, it is a mandate that employers require that their employees get a COVID-19 vaccine. And there are other hair-brained ideas on the way, including those that would force health care facilities to require vaccinations in order to receive Medicare and Medicaid reimbursements. Holding our seniors and Medicaid recipients hostage is just plain wrong.

This federal overreach is plainly unacceptable. Let me be clear: Wyoming will use every means at our disposal to thwart these efforts to erode our rights. I have directed Wyoming’s Attorney General to work with other states to prepare for litigation once the vaccine mandate regulations are released.

From the outset of this Biden threat, Legislative leadership and I have been aligned in our steadfast opposition to federal overreach. Rest assured, we have heard similar sentiments from all corners of the state. Together, we are working hard on behalf of Wyoming. However, I will not support state over-reach into our private and business lives.

As chief executive of Wyoming, I’m acutely aware of the limits imposed on my office by our Constitution and the statutes passed by our Legislature. Wyoming’s statutes do not provide the Governor with unlimited power. For example, Wyoming’s brand of Executive Orders (EOs) do not give the Governor the same tools that the Texas Legislature has given their Governor. Because Wyoming’s Governor does not have statutory authority to enforce an EO similar to Texas’ Governor, I have not issued one. Frankly, I am not disappointed because I believe in my core that Wyomingites don’t want a supreme executive in the first place. Government must be held in check.

The Wyoming Legislature has the authority to call itself into session when they are so inclined. Their process is not easy, and it isn’t meant to be. Wyoming prides herself on a citizen legislature made up of men and women with jobs, businesses, and obligations that are not wholly political in nature. We are blessed that we do not have a “political class” as found in New York, California, or Illinois. Wyoming has avoided that pitfall by limiting the days that our Legislature can be in session, thereby assuring that our legislators continue their other work, and concentrate on politics as a service.

The Legislature is following its process. I look forward to continuing to work with them to see that we protect the rights of Wyoming individuals and businesses. It is, and always has been, a delicate balance.

Ultimately, I remain committed to conservative Republican principles: minimal government closest to the people, individual liberty, and the freedom to operate your business unconstrained from government mandates. I will always stand for the Constitution and the rule of law. I was proud when former President Donald Trump recognized Wyoming’s limited regulations when I met with him at the White House in 2019. I continue to be proud of our state’s commitment to keep out of the business of our citizens and their businesses.

Europe’s energy crisis better wake America up

As the twenty-sixth massive climate control “conference of parties” goes live in Glasgow, Europe’s energy woes continue to worsen – making energy problems here in the USA seem mild by comparison – but also portending what could be ahead for us Americans. Indeed, continuing along the trajectory President Biden and the Democrats have laid out for us would impose a real crisis that will destroy US industries, communities, jobs, living standards and lives.

COP-26 begins today – on Halloween, which is eminently appropriate, since their primary goal right now is to terrify humanity into ignoring this looming energy, economic, health and human rights crisis … and convince us to forget about natural climate change and take immediate, drastic, but futile action to “prevent a man-made climate cataclysm.”

COP-26, the twenty-sixth massive climate conl take private jets and limos to the lecture and hector halls – to demand that “commoners” be restricted to one Basic Economy flight every three years, meatless diets, public transportation, and keeping 640-square-foot homes at 65 F all winter and 85 F all summer.

Otherwise, they say, countless people will die as our planet “overheats” by up to 4.1 degrees C (7.2 F) by 2100. Real-world science and data provide no support for temperature spikes of this magnitude. But just in time for COP-26, Columbia University concocted a “new study” and “new metric” on the “mortality cost of carbon,” based on these scary computer-modeled temperature forecasts.

Bloomberg News gave the death-by-global-warming fable prominent coverage. 83 million people (equivalent to the entire population of Germany) “could be killed” this century by rising planetary temperatures caused by fossil fuel use, it asserted. Nonsense.

Modern housing and energy systems enable people to adapt to and survive even the most extreme heat and cold – even in Antarctica, which just experienced the coldest average winter temperatures ever recorded: -61 C (-78 F).

Survival becomes far less likely, however, if climate treaties and energy policies prohibit efficient air conditioning and heating, ration them, subject them to recurrent blackouts, or make them harder to afford amid rising oil, natural gas, coal and electricity prices.

Yet that is exactly what’s being advocated and implemented. Britain and various US cities and states want to ban natural gas heating and cooking – and replace them with expensive heat pumps and other electric appliances, powered by expensive, weather-dependent wind turbines and solar panels. Meanwhile, energy prices have been skyrocketing in response to Covid recovery and anti-fossil-fuel policies.

Climate theory has long held that most 21st-century warming will occur in northern latitudes during winter months. But now we’re now told a warming Arctic could also be causing colder winters, which could endanger far more people than rising temperatures or more frequent heat waves.

Actually, far more people die in cold weather than in hot weather or heat waves. In the United States and Canada, cold causes 45 times more deaths per year than heat: 113,000 from cold versus 2,500 from heat. Worldwide, where air conditioning is far less available, some 1,700,000 people die annually from cold versus 300,000 from heat – a ratio of almost 6:1.

Energy policies that favor wind and solar over fossil fuels beget “fuel poverty” that can make adequate heating impossible, causing numerous health problems and deaths. Poor, minority, elderly and fixed-income families are most severely and inequitably affected, it found.

Cold homes bring increased risks of respiratory and circulatory problems (including asthma, bronchitis, flu, cardiovascular disease and stroke) and exacerbate existing adverse health conditions. Cold household temperatures also increase depression, anxiety and other mental health problems. Already vulnerable groups – young children, older people and those with preexisting health issues – are especially susceptible to hypothermia, more illness and death.

Public Health England calculated that one-tenth of all “excess winter deaths” in England and Wales are directly attributable to fuel poverty, and 21.5% of excess winter deaths are attributable to the coldest 25% of homes. 30,000 to 40,000 people died each year in England and Wales since 1990 who would not have perished if their homes hadn’t been so cold, researchers estimated.

Adjusted for population, this is equivalent to 165,000 to 220,000 excess American winter deaths per year.

In 2017, Germany endured 172,000 localized blackouts; in 2019, 350,000 German families had their electricity cut off because they couldn’t pay their power bills.

Coal, oil, natural gas, electricity and home heating costs have risen significantly since those studies were prepared, likely increasing the excess winter death toll markedly. In fact, 2021 European gas prices skyrocketed nearly 600% over 2020 prices, and Rotterdam coal futures soared from $60/ton in October 2020 to $265/ton in September 2021. Energy prices are still rising, affecting jobs and living costs.

Global demand for gas and coal has surged as the world recovers from Covid. British gas production has plunged by 60 % since 2000; Britain and Europe have banned fracking; Putin is playing politics over how much gas it will dtrol “conference of parties,” goes live in Glasgow, Scotland on Halloween. That’s certainly appropriate, since its primary purpose is to further terrify humanity to “take action” to prevent the “existential threat” of “manmade climate cataclysms.”

Thousands of politicians and climate activists wileliver to Europe; and President Biden has stymied leasing, drilling, fracking, pipelines, and oil and gas exports. Many coal and nuclear power plants have been shut down. Meanwhile, Europe’s heavily subsidized wind turbines generated far less electricity in 2021 due to unfavorable winds.

This perfect storm of misinformed policies could bring unprecedented excess deaths as winter sets in.

Schools, hospitals and clinics could also be much chillier – and deadlier. At 11¢ per kilowatt-hour (average US business rate), a 650,000-square-foot hospital would pay about $2.2 million annually for electricity. At 25¢ per kWh (UK), the annual cost jumps to $5 million; at 35¢ per kWh (Germany), to $7 million! Those soaring costs would likely result in employee layoffs, higher medical bills, reduced patient care, colder conditions, and more deaths.

Adding to these woes, Citigroup says EU natural gas prices could hit $100 per mcf (per thousand cubic feet or million Btu) if this winter is particularly cold and more Gulf of Mexico hurricanes disrupt production. News outlets report that energy companies supplying six million UK homes face collapse, and several elder care homes have warned that crippling energy bills could force closures, leaving many old and infirm people homeless.

Britain’s energy minister has said a “very difficult winter” lies ahead, as gas prices soar amid fear of blackouts and food shortages. Many households “will not be able to cope.”

US energy prices remain well below Europe’s, but threats to American families are also rising. The average monthly Henry Hub spot price for natural gas has shot from $1.63 in June 2020 to $5.16 in September 2021. That’s well below the highest-ever price ($13.42 in October 2005) but still ominous.

One-third of American households already had difficulty six years ago adequately heating and cooling their homes – and one-fifth of households had to reduce or forego food, medicine and other necessities to pay energy bills. Even before Covid, low-income, Black, Hispanic and Native American families were spending a greater portion of their incomes on energy than average US households.

Nearly half of US households that heat with natural gas will spend 22-50% more this winter than last year, depending on how cold it gets. Families that use electricity, propane or fuel oil to heat their homes will also pay significantly more. Energy-intensive factories may have to cut back hours and production, lay people off, and move operations overseas (where they will continue to burn fossil fuels and emit greenhouse gases).

Americans are also being impacted by gasoline prices that have risen more than a dollar a gallon for regular since the 2020 election and recently reached $5.00 per gallon in New York and $7.60 in one southern California town.

The overall effect of these anti-fossil-fuel policies on livelihoods, living standards, health and life spans will be profoundly negative. Countless people will perish, many of them cold and jobless in the dark.

Under Joe Biden, the United States is already on a trajectory to Europe’s real climate crisis: unaffordable, unreliable energy. That crisis better wake America up. Otherwise, self-righteous activists and governing classes will destroy middle class jobs, families – and lives.

Wyoming Lawmakers: What’s Taking So Long?

The Senate voted down Senate File 1010, the Grace Smith Freedom Act, on Tuesday by an 18-11 vote. The bill, sponsored by Sen. Bo Biteman (R-Ranchester) and Rep. Ocean Andrew (R-Laramie), was named after a 16-year-old Laramie High School junior who was arrested on Oct. 7 for refusing to wear a face mask.

The bill would have required “county and state health officers to grant waivers to immunization requirements for K 12 students upon request; requiring county and state health officers to grant mask mandate waivers for K 12 students upon request.”

Those voting against medical freedom included 16 Republicans: Sen. Jim Anderson (R-Casper), Sen. Fred Baldwin (R-Kemmerer), Sen. Cale Case (R-Lander), Sen. Ed Cooper (R-Ten Sleep), Sen. Dan Dockstader (R-Afton), Sen. Ogden Driskill (R-Devils Tower), Sen. Dan Furphy (R-Laramie), Sen. Larry Hicks (R-Baggs), Sen. Dave Kinskey (R-Sheridan), Sen. John Kolb (R-Rock Springs), Sen. R. J. Kost (R-Powell), Sen. Bill Landen (R-Casper), Sen. Tara Nethercott (R-Cheyenne), Sen. Drew Perkins (R-Casper), Sen. Charles Scott (R-Casper) and Sen. Jeff Wasserburger (R-Gillette). The Senate’s only Democrats, Sen. Mike Gierau (D-Jackson) and Sen. Chris Rothfuss (D-Laramie), also voted against the bill.

Joining Biteman in voting for medical freedom included Sen. Brian Boner (R-Douglas), Sen. Anthony Bouchard (R-Cheyenne), Sen. Affie Ellis (R-Cheyenne), Sen. Tim French (R-Powell), Sen. Lynn Hutchings (R-Cheyenne), Sen. Tom James (R-Rock Springs), Senator Troy McKeown (R-Gillette), Senator Tim Salazar (R-Riverton), Sen. Wendy Schuler (R-Evanston) and Sen. Cheri Steinmetz (R-Lingle).

Grace Smith spoke to a crowd of supporters of the bill at the State Capitol on Oct. 26 before the bill was voted down later that day. She vowed to keep fighting for liberty.

“I’m so grateful to be a part of this fight with all of you, and especially to all you kids out there please, please keep fighting,” Smith said. “This is about you. And parents, this is about you too. It’s not about me.”

Smith added: “It’s just absolutely amazing to see all these people here, and it’s really, really encouraging to me and my family to see so many people supporting us through all of this. I know it’s a scary fight and so I just encourage all of you to just continue to fight for all the liberties of American citizens.”

Beyond being arrested, Smith received $1,000 in fines by the Laramie Police Department for politely refusing to obey the unlawful dictates of the school administration regarding masks. She was handcuffed on school grounds while the police also put the school on lockdown.

Even after this act of tyranny, the Board of Education in Albany County School District 1 doubled down to keep the mask mandate in place at an Oct. 13 board meeting. Smith gave public comments at that meeting announcing she was withdrawing from the school district.

A fundraising account was created on Give Send Go for Grace. The Smith family provided an update on the site stating Grace has started a homeschool program and that the City of Laramie has dismissed one of the two fines she received and they expect the second to also be dismissed.

“We are trusting that God is in control and His will be done as it pertains to the criminal charges against Grace,” the update stated. “On the larger civil law case, we have joined two different fights. We are part of a larger class action federal case that hopes to restore liberty back to the people. This will be filled in a federal court in the 10th district and is the case we hope will have the desired outcome for not only Wyoming but other cases like it in the country. Grace is also going to be part of a more local state case that will not only involve her but others from our school district. This case will be more tied to her situation specifically and involve other students from her school district.”

Wyoming Senate Will Not Protect Medical Freedom Of K-12 Kids

Wyo Weston County Prosecutor Calls Good Evil and Evil Good

A Wyoming prosecutor has decided not to charge library employees for making available, hard core sex LGBTQ themed books in public libraries for children and teenagers to read and look at pictures.

The Liberal radical Democrat WOKE agenda is pushing to influence Wyoming kids and is running rampant in the state of Wyoming.

This time it was over six books titled, “Dating and sex: A guide for the 21st Century Teen Boy” written by Andrew P. Smiler.

“Doing it” by Hannah Witton “How Do You Make Babies.” by Anna Fiske, “This book is Gay” by Juno Dawson, and last but not least in the library “Sex is a Funny Word.” by Cory Silverberg.

These LGBTQ-themed propaganda WOKE agenda is designed to destroy the modern American family and teach what’s up is down and what’s down is up, which includes having no Genders allowed.

LGBTQ Executive directory of the LGBTQ Advocacy Group for Wyoming Equality has stated openly that if a person complains about these books, this poses a “Real Threat” to the LGBTQ Gay community.

Yet these are the same people who demand that straight individuals comply with their radical liberal Democrat WOKE sexual agenda’s and want the world to hear their voices, but on the other side of the coin, if an individual disagrees and stands up and tells them that this is not morally, ethically nor GODLY right, for little children to be subjected to this propaganda, the Sara Burlingame’s of the world become unhinged.

Weston County Attorney Michael Stulken has stated that he “Cannot ethically bring criminal charges if the facts that surround a certain matter don’t support probable cause.”

So basically Weston County Attorney, Michael Stulken is calling Good Evil and Evil Good.

The State of Wyoming is heading down a really dark road in its future for the children of Wyoming if they continue this behavior. But then, according to this Weston County Prosecutor, he would probably give a legal excuse why it is ok to have sex with little children against their will. Oh, maybe there is no “probable cause.” Such as Michael Stulken would like the public to believe. Maybe Wyoming would be better off if the residents went back to the wild west days at this rate.

Wyoming Coal Plant Employees Protesting Illegal Vaccine Mandate

Wyoming Coal has been a stable energy for decades, now the radical Joe Biden has sent a blow to the Wyoming coal industry again. This time demanding that his vaccine mandate be forced on all coal workers.

This is effecting many coal workers in Gillette, Wyoming as now workers are staging a protest to the federal vaccine mandate outside the Dry Fork Station just outside of Gillette, Wyoming. The Northern Wyoming Coal plant is in a spiral downward because of the Biden vaccine mandate, which is ILLEGAL.

58 coal worker employees at the Gillett Dry Fork Station spent their day on Tuesday protesting the mandate. The workers have been told to either get vaccinated or lose your job.

No one is against the vaccine, but to be forced under an illegal mandate to get the vaccine is a major problem for most people in America. They held the protest at the coal plant on the first day of the Wyoming Special Legislative Session. But so far the Wyoming Republicans still are not protecting Wyoming workers.

Too many Republicans are Rhinos and need to be removed from their position, as they do not have the will of the people of Wyoming.

Biden can go shove his signed executive order up his south end, as America is pushing back against the covid-19 vaccination or weekly testing for employees at companies with at least 100 employees.

Wyoming only has 23% of the population has vaccinated according to the CDC records.

The Wyoming Department of Health records state that 40% have received the vaccination.

But those records are not accurate.

The Laramie River Station and the Basin Electric Coal plant are planning a protest on November 5, 2021. The public is welcome to come join them, say the employees of the coal plants.

Illinois Federal Court Issues Restraining Order RE: Vax Mandates

The committee to elect Rex Rammell Governor of Wyoming is officially announcing his campaign with the website www.rammellforgovernor2022.com and releases the following press statement:

Wyoming continues to struggle with multiple issues, but none greater than the lack of leadership provided by Governor Gordon. Wyoming leads the nation in Covid 19 deaths per capita and has the second lowest vaccination rate in the United States. A special legislative session to protect Wyoming citizens from unconstitutional mandates by the federal government is currently meeting. Governor Gordon released the following statement at the beginning of the session

“It has been hard to stomach the increasingly aggressive license the Biden administration has taken over the past few months to extend the federal government’s overreach into our lives,” Gordon’s letter stated. “This temerity is offensive to me, to you, to Wyoming citizens and to the Constitution that enumerates our rights. It must be stopped.”

The hypocrisy of Governor Gordon has no bounds! It wasn’t long ago in the beginning of the pandemic, Governor Gordon gave authority to and stood behind mask mandates and illegal business shutdowns. Now he is the town crier for constitutional freedom.

For the record, Rex Rammell is pro vaccination and anti mandate. He is a Doctor of Veterinary Medicine and believes in vaccines. He is urging that all eligible citizens in Wyoming be vaccinated by choice. The risk of death is much greater than the risk of adverse reactions to the vaccine. Fight the mandates, but get vaccinated.

Dr. Rammell will be on a “get vaccinated” tour of the state of Wyoming the week of November 1st.
